When we attempt to solve a moral dilemma, we follow a process of moral reasoning, we explore available data, and we take into consideration certain consequences with respect to these data and the moral standards. Individuals are sometimes seen to make wrong decisions and display unacceptable behavior in facing relevant situations due to their negligence or their poor knowledge of the standards and skills of making decisions. In this article, I study this subject as a theme in applied ethics and as an epistemic issue related to criminal law in the light of moral philosophy and jurisprudential principles, and some Iranian regulations. The question at issue in this study is “what is a moral dilemma? What kind of benefit does it bring to criminal law? And how can we get out of the current situation?” The method of this inquiry is descriptive and analytical while library research methodology and interdisciplinary approach are used. </span> تنگناهای اخلاقی، افزون بر  این ‌که از بحث‌برانگیزترین مسائل دهه‌های اخیر فلسفۀ اخلاق بوده است؛ در قلمرو علوم انسانی مانند حقوق و فقه نیز مطرح است. زمانی که ما تلاش می‌کنیم تا یک تنگنای اخلاقی را حل کنیم از فرایند استدلال اخلاقی، پیروی می‌کنیم، اطلاعات موجود را بررسی می‌کنیم و پیامدهایی را با توجه به آن اطلاعات و در ارتباط با معیارهای اخلاقی در نظر می‌گیریم. گاهی مشاهده می‌شود که اشخاص در مواجهه با وضعیت مذکور، به دلیل غفلت و یا ضعف در شناخت معیار و مهارت‌های تصمیم گیری، دچار تصمیم‌‌گیری و رفتار نادرست می‌شوند. در این مقاله، این موضوع به عنوان یکی از موضوعاتِ اخلاق کاربردی و مسائل معرفتی مرتبط با حقوق کیفری با نگاهی به فلسفۀ اخلاق و اصول فقه، و برخی مقررات ایران بررسی می‌شود. پرسش مدِّ نظر در این پژوهش عبارت است از  این ‌که تنگنای اخلاقی چیست و چه ثمره‌‌ای در حقوق کیفری دارد و راه برون رفت از این وضعیت چیست؟ روش تحقیق مدِّ نظر در این مقاله، توصیفی – تحلیلی، با بهره‌‌گیری از ابزار کتابخانه‌‌ای و مطالعه میان‌رشته‌‌ای است. https://ethics.riqh.ac.ir/article_13222_896d8cdd9cc0a6a5d8ce09e25e4989e9.pdf
