This study introduces a new framework, termed "Ethical-Oriented Ijtihad," which explores the impact of ethical teachings on the derivation of Islamic legal rulings. Ethical-oriented ijtihad emphasizes not only the outward behavior but also the inner virtues and moral character of individuals in the process of jurisprudential inference. In this approach, the ultimate goal of fiqh is the attainment of human well-being and happiness, rather than merely identifying binding evidence (hujjah).This framework requires jurists to adhere to the broader principles of rational ethics, professional ethics in ijtihad, and belief ethics in jurisprudence. It encourages jurists to explore new ethical dimensions in fiqh-related issues, reevaluate traditional subjects with a deeper anthropological perspective, and give due consideration to moral evidence and principles that are often overlooked in the process of inference. Ethical-oriented ijtihad seeks to achieve greater harmony between ethical and legal rulings, resulting in jurisprudential conclusions that are defensible from a moral standpoint.<br /><br /> در دوران معاصر - به دلیل قرابت فقه و اخلاق اسلامی - نحوۀ اثرگذاری این دو علم بر یک‌دیگر مورد توجه اندیشمندان قرار گرفته است. در پژوهش حاضر از طریق بررسی تأثیرات علم اخلاق بر استنباط احکام فقهی، در پی معرفی طرح جدیدی از تأثیرگذاری آموزه‌های اخلاقی بر استنباط فقهی با عنوان «اجتهاد اخلاق‌گرا» هستیم. اجتهاد اخلاق‌گرا، طرحی است که در آن استنباط فقهی در کنار رفتار به ملکات و ویژگی‌های درونی نیز توجه می‌شود. در این سبکِ اجتهاد، هدف «علم فقه» دستیابی به سعادت انسان است و نه صرف یافتن حجّت. در این طرح، فقیه باید به چارچوب کلی اخلاق عقلانی، اخلاق حرفه‌ای اجتهاد و اخلاق باور فقهی بپردازد و به لوازم آن متعهد باشد، در حوزۀ موضوعات فقهی، موضوعات جدیدی را مورد توجه قرار داده و موضوعات پیشین را با توجه به انسان‌شناسی عمق بخشد، در حوزۀ احکام استنباطی نیز به قرائن‌‌ و قواعد اخلاقی که معمولاً مورد غفلت واقع می‌شود، توجه کند. اجتهاد اخلاق‌گرا طرحی برای دستیابی به هماهنگی هر چه بیشتر میان احکام فقهی و احکام اخلاقی و استنباطات فقهیِ قابل دفاع به لحاظ اخلاقی است. <br /><br /><br /><br /><br />  https://ethics.riqh.ac.ir/article_13738_3ec27cb1a4803bf8147f2343599839a1.pdf
